General Terms and Conditions of Sale (GTC)

  1. Purpose: These General Terms and Conditions of Sale (G.T.C.) govern sales made on the JOLBRO SAS website, to the exclusion of any other distribution channel. JOLBRO SAS is a company registered with the Lille Trade and Companies Register under number 949 669 782, whose registered office is located at 23 rue Cendrillon, 59650 Villeneuve d'Ascq, France. Its main activity is the purchase, resale, and consignment sale, by any means and in any location, of all furniture, objects, equipment, and products, whether new, old, or handcrafted, for a private, professional, or public clientele.
  2. Products: All items offered by JOLBRO SAS are second-hand goods, antiques, or collectibles. As such, they may show signs of age, defects, or damage. A detailed description and photos are provided for each item. They are sold as-is, as non-functional (unless otherwise stated in the product description), and for collection purposes only. Therefore, the Client may not claim any refund or compensation and shall not hold JOLBRO SAS liable for any defect, flaw, malfunction, or other issue arising from the use or misuse of the item. JOLBRO SAS shall not be held responsible for possible errors or inaccuracies in product descriptions, especially regarding their origin, era, or supposed use, as the interpretation of such information remains subjective. Furthermore, photographs and dimensions are not contractually binding. Minor differences may exist between the photographed item and the item delivered, especially due to lighting conditions or screen display. Dimensions are provided as an indication and may vary by a few millimeters.
  3. Prices: Prices are indicated in euros and exclude shipping costs, which are borne by the Client and specified at the time of order confirmation. JOLBRO SAS is subject to the special VAT regime on the margin for second-hand goods – Article 297A of the French General Tax Code and EU Directive 2006/112/EC.
  4. Orders: Prior to placing an order, the Client acknowledges having read and accepted these General Terms and Conditions without reservation. The order is validated upon confirmation and receipt of payment, which implies acceptance of the prices and product descriptions. JOLBRO SAS reserves the right to cancel or block any order in the event of non-payment, partial payment, incomplete or incorrect delivery information, or in case of an unresolved dispute related to a previous order from the Client.
  5. Payment: Payment is made at the time of the order, in euros, by credit card, Paypal, or any other method previously agreed upon between JOLBRO SAS and the Client. Pursuant to Article L.132-2 of the French Monetary and Financial Code, the commitment to pay by credit card is irrevocable. By providing their credit card information, the Client authorizes JOLBRO SAS to debit the card for the amount of the order. If the payment cannot be processed, the online sale will be automatically terminated and the order cancelled.
  6. Product availability: Most of the products offered by JOLBRO SAS are unique pieces and therefore available in only one copy. Although JOLBRO SAS strives to regularly update product availability, an error or omission may prevent the delivery of an ordered item. In such a case, JOLBRO SAS will inform the Client and refund the price of the unavailable item.
  7. Obvious error: In the event of a manifest error in a product listing (price, dimensions, weight, shipping cost, or any other essential detail) that impacts the final price of an order, JOLBRO reserves the right to cancel said order. The client will be informed as soon as possible of the correction. They may then choose to confirm the order at the corrected price or cancel it and receive a full refund.
  8. Delivery to pickup point or address: Orders are generally shipped within 2 to 5 business days after order confirmation, via the carrier chosen by JOLBRO SAS. To this period is added the carrier’s delivery time (2 to 21 days depending on the destination and delivery method). Products are shipped to the designated pickup point or delivery address. If the selected pickup point is unavailable at the time of label creation, JOLBRO SAS will contact the Client to choose another one. If no reply is received, JOLBRO SAS may select a nearby pickup point based on the address provided in the order. In the case of an incorrect address, JOLBRO SAS shall not be held liable. If the parcel is not collected within the carrier’s timeframe, it will be returned to sender, and the Client will bear the cost of reshipment. For deliveries outside France (Incoterm DAP), duties, taxes, and import fees are the Client’s responsibility. The Client agrees to check local import laws before ordering and expressly commits to paying any applicable import duties, taxes, and fees, and shall not hold JOLBRO SAS liable in any way for customs retention or related issues.
  9. Order pickup service: During checkout, the Client may opt for free pickup of their order in Écuires (62170 – near Montreuil-sur-Mer) or Villeneuve d'Ascq (59650 – near Lille). Pickup requires scheduling an appointment by phone. All items are stored by default in our Écuires warehouse and are generally available there within 24 to 48 hours. For pickups in Lille, we offer item transfers from our warehouse, with a delay ranging from 5 to 20 business days depending on the period. In all cases, JOLBRO SAS will inform the Client by email of the order's availability and provide a phone number to arrange the pickup.
  10. Deferred delivery service (service suspend): During checkout, the Client may opt for deferred delivery. The order is then set aside, allowing the Client to consolidate shipping costs with future purchases. The Client will notify JOLBRO of their wish to ship their deferred orders by email or via the website chat. JOLBRO will then send the total shipping cost and a secure payment link. Upon payment confirmation, the orders will be shipped under the aforementioned conditions.
  11. Order reception: Upon receipt of the order, the Client must check the condition of the packaging and the conformity of the delivered items. In the event of any issue (missing or damaged item, opened or deteriorated package…), the Client must: clearly note specific and justified reservations on the delivery slip; refuse the parcel if needed; confirm the issue in writing (letter or email with photos) to JOLBRO SAS within 48 hours. Without notification within this period, the delivery is deemed compliant and no claim will be accepted.
  12. Right of withdrawal: In accordance with French law, you have 14 days from receipt to exercise your right of withdrawal, except for exceptions under Article L221-28. Return costs are the buyer's responsibility. To exercise your right, you must notify us via the website contact form within the allowed timeframe, clearly stating your intent to withdraw, your order number, and your full contact details. Items must be returned in their original condition, along with the return slip, to the address provided in the acknowledgment of your withdrawal request. Upon receipt and verification of the returned items, we will issue a refund within 14 days, excluding return costs which remain at your expense. No refund will be issued if the return slip is missing or if any item is missing or not returned in original condition. In this case, the Client may request reshipment of their order at their own expense. This right of withdrawal does not apply to professional clients acting within the scope of their business activity.
  13. Limitation of liability: JOLBRO SAS shall not be held liable for any delay or failure to make the order available due to Force Majeure (pandemic, fire, strike, flood, etc.). In any case, the liability of JOLBRO SAS, regardless of the grounds, shall never exceed the purchase price of the order.
  14. Retention of ownership: Products remain the exclusive property of JOLBRO SAS until full payment of the price by the Client.
  15. Order archiving and electronic proof: Order confirmations and invoices are archived on a reliable and durable medium and may be used as evidence. The computerized records stored in JOLBRO SAS’s IT systems under reasonable security conditions shall be considered as proof of communications, orders, and payments between the Parties.
  16. Disputes: In case of dispute, an amicable solution will be sought. In accordance with Article L.612-1 of the French Consumer Code, the Client may refer the matter to a consumer mediator free of charge (list available at: mediation-conso.fr).
  17. Governing law / Jurisdiction: These conditions and the relationship between the Parties are governed and interpreted according to French law. In case of dispute regarding the validity, interpretation, or execution of these terms not resolved amicably, jurisdiction is expressly granted to the Commercial Court of Lille, notwithstanding multiple defendants or third-party claims, including for emergency or protective procedures, summary proceedings, or by petition.
  18. Data protection: No personal data is used for commercial purposes without prior consent. In accordance with the GDPR, the Client has the right to access, rectify, oppose, and delete their personal data. For more information, please consult our privacy policy.
